DeLand, FL – The Deltona man charged with the murders of his wife and 2 step-kids doesn’t want to wait any longer for a Volusia County jury to hear his defense.
In a hearing set for 8:30 AM Friday at the Volusia County Courthouse in DeLand, Luis Toledo and his legal team will ask Volusia County Judge Raul Zambrano to begin his trial as soon as possible.
This move comes after Zambrano ruled last month in favor of the prosecution’s request to delay the trial until Florida legislators figure out what to do about state’s death penalty process. It was slated to begin on January 19th in St. Augustine after Zambrano decided to move the trial from Volusia County due to heavy media coverage.
Zambrano’s decision came after the United States Supreme Court ruled in the Hurst v. Florida case that Florida’s death penalty process was unconstitutional because it required a simple majority of a 12-person jury to decide if the death penalty should be applied.
